Terms of Service — Linaw

1. Who we are

Linaw ("Linaw", "we", "us", "our") is an iOS personal finance tracking application operated by Kristoff Ampong, a self-employed individual based in Dumaguete City, Negros Oriental 6200, Philippines, with contact email [email protected].

These Terms of Service ("Terms") govern your use of the Linaw iOS application and any associated services (collectively, the "Service"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use Linaw. If you are between 13 and 18 (or the age of majority in your jurisdiction), you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You may not use the Service if you are barred from doing so under the laws of your country of residence or the Republic of the Philippines.

3. Your account

Most free-tier features are available without an account. Receipt scans and buying Pro or credits require sign-in via Sign in with Apple. We do not offer username/password accounts; we do not store passwords.

You are responsible for the security of the Apple ID associated with your account. Linaw is not responsible for losses resulting from unauthorized access to your Apple ID.

4. What Linaw does — and does not — provide

4.1 Service description

Linaw helps you log personal financial transactions via voice, manual entry, and receipt capture, and presents your own logged data back to you in dashboards, charts, and calendars. Linaw is a personal record-keeping tool.

4.2 No financial advice

Linaw is not a financial advisor, accountant, tax preparer, broker, or investment service. Totals, charts, summaries, and anything AI Features read for you ("Estimates") are computed from the transactions you have logged. They are estimates only, not advice, recommendations, or guarantees.

You should not rely on Estimates for decisions about investments, taxes, debt, credit, business operations, or any other financial matter. Consult a qualified professional for advice tailored to your circumstances.

4.3 No banking or money transmission

Linaw does not hold funds, transmit money, link to bank accounts, execute trades, or extend credit. All transactions logged in the Service are records of activity that occurred outside the Service.

4.4 No professional bookkeeping

Linaw is designed for personal use. It is not represented as a substitute for double-entry bookkeeping, audited records, or any regulated accounting workflow. Do not rely on Linaw as the system of record for a registered business.

5. AI features and accuracy

5.1 How AI is used

Some features ("AI Features") send portions of your input to third-party AI providers for processing. As of the effective date, the AI provider is Google LLC, via the Gemini API. The current list of AI providers is disclosed in our Privacy Policy.

What is sent to AI providers:

  • Voice transcripts (Pro only) — the text of a voice entry your phone couldn't read on its own, plus your category and merchant names, for parsing into a transaction.
  • Receipt images (every plan) — the image you captured, for OCR. Images are deleted within 60 seconds of processing.

A voice entry or receipt can include an amount.

What is not sent to AI providers:

  • Your balances, account names, or transaction history.

5.2 Estimates only

AI Features produce Estimates, not facts. Voice parsing and receipt OCR can misread amounts, merchants, or categories. Linaw surfaces a confirm step for low-confidence and anomalous entries; you are responsible for reviewing and correcting what is saved.

5.3 Mandatory disclaimer

Charts and other Estimates carry the disclaimer:

Estimates based on your logged data. Not financial advice.

You acknowledge that this disclaimer applies to every AI output regardless of whether it is visible at the moment you read it.

6. Subscriptions, credits, and payment

6.1 Free and Pro tiers

Linaw offers a Free tier and a Pro tier. The current feature split between Free and Pro is described in-app.

6.2 Pricing

As of the effective date:

  • Pro Monthly: US$3.99 per month (Philippine peso price as shown in the App Store)
  • Pro Annual: US$29.99 per year (Philippine peso price as shown in the App Store)
  • Credit Top-up: ₱49 / $0.99 per pack (consumable, 500 credits)

Pricing is set in App Store Connect and is subject to change. Apple may convert prices to your local currency at its prevailing rates.

6.3 Billing and renewal

All payments are processed by Apple via the App Store. Subscriptions auto-renew until canceled. You can manage and cancel your subscription at Settings → Apple ID → Subscriptions on your device, or via the App Store. Cancellation takes effect at the end of the current billing period.

6.4 Refunds

Refunds are handled exclusively by Apple under the App Store's refund policy. Linaw cannot grant refunds directly. Submit refund requests at https://reportaproblem.apple.com.

6.5 Credits

Pro features that call AI providers consume "Credits." Credits granted as part of a subscription expire when the subscription period ends. Credits purchased as consumable top-ups do not expire but are non-transferable, non-refundable (subject to Apple's policy), and have no cash value.

6.6 Family Sharing

If Apple Family Sharing is enabled, your Pro subscription entitlement may be shared with family members per Apple's rules. Credits are per-Apple-ID and are not shared. Each family member has their own credit balance.

7. Your content and data

7.1 Ownership

You own the transactions, notes, photos, voice transcripts, and other content you create or upload ("Your Content"). We claim no ownership over Your Content.

7.2 License to operate the Service

You grant Linaw a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely for the purpose of providing the Service to you. This license terminates when you delete Your Content or close your account, except where retention is required by law or for legitimate backup purposes (rolling 30-day window).

7.3 Export and deletion

You may export Your Content as CSV or JSON at any time via Settings → Export. You may delete your account at any time via Settings → Delete Account, which triggers server-side deletion within 30 days. See the Privacy Policy for full details.

8. Acceptable use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Log transactions that misrepresent the source of funds for tax evasion, money laundering, or other illegal activity.
  • Reverse engineer, decompile, or attempt to extract source code, except as permitted by applicable law.
  • Probe, scan, or attempt to breach the Service's security.
  • Use the Service to harass, defame, or harm any person.
  • Resell, sublicense, or commercially redistribute the Service or its output.
  • Use automated means (scrapers, bots) to interact with the Service except as expressly permitted.

We may suspend or terminate your account for violations of this section, with or without notice depending on severity.

9. Intellectual property

Linaw, the Linaw name, logo, app, app icon, website, brand assets, and all underlying software are owned by Kristoff Ampong and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right in our trademarks or branding.

The Service is licensed, not sold, to you.

10. Third-party services

The Service integrates with third-party services including Apple (Sign in with Apple, App Store, StoreKit, CloudKit), Supabase Inc. (backend hosting), and Google LLC (AI processing via the Gemini API). Your use of those services through Linaw is also subject to their respective terms. We are not responsible for third-party services' acts or omissions.

11. Beta and pre-release features

Some features may be released as beta, preview, or experimental. These features are provided as-is, may be unstable, may produce inaccurate output, and may be modified or removed at any time. Do not rely on beta features for any decision of consequence.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LINAW AND ITS OPERATORS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

WITHOUT LIMITING THE FOREGOING:

  • We do not warrant that AI Features will produce accurate, complete, or appropriate results.
  • We do not warrant that the Service will be available without interruption, free of bugs, or secure against unauthorized access.
  • We do not warrant that data sync (including via Apple iCloud) will be timely, complete, or free of conflicts.

Some jurisdictions do not allow disclaimer of certain warranties; in those jurisdictions, our disclaimers apply only to the maximum extent permitted by law.

13. Limitation of liability

To the maximum extent permitted by law, Linaw's total cumulative liability to you for any and all claims arising out of or relating to these Terms or the Service — whether in contract, tort, statute, or otherwise — is capped at the total subscription fees you actually paid to Linaw in the twelve (12) months immediately preceding the event giving rise to the claim.

If you used the Service only on the Free tier during that period, this cap is zero.

In no event will Linaw be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost data, lost savings, business interruption, or financial loss resulting from reliance on AI Features or any Estimate.

Some jurisdictions do not allow exclusion of certain damages or limits on liability; in those jurisdictions, our exclusions and limits apply only to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless Linaw and its operators from any claim, demand, loss, or expense (including reasonable legal fees) arising out of:

  • Your violation of these Terms;
  • Your misuse of the Service;
  • Your violation of any law or the rights of any third party.

15. Termination

You may stop using the Service at any time. You may close your account via Settings → Delete Account.

We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. We will give reasonable advance notice when practical, except for violations that present immediate risk.

Sections that by their nature should survive termination (including 4.2–4.4, 5.2–5.3, 7.1, 9, 12, 13, 14, and 17) survive.

16. Changes to these Terms

We may revise these Terms from time to time. Material changes will be surfaced in-app and at https://linaw.app/terms with a revised effective date. Continued use of the Service after a revision takes effect constitutes acceptance.

If you do not accept a revision, your remedy is to stop using the Service and delete your account.

17. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-laws principles. The Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the competent courts of Dumaguete City, Negros Oriental, Philippines. You and Linaw each waive any objection to that venue.

For users residing in jurisdictions where local consumer-protection law grants non-waivable rights (such as the EU), nothing in this section limits those rights.

18. Apple-specific terms

These Terms are between you and Linaw, not between you and Apple. Apple is not responsible for the Service or its content. Notwithstanding, Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. The following Apple-required acknowledgments apply:

  • The Service is licensed to you for use only on Apple-branded devices that you own or control, per the Apple Media Services Terms.
  • Apple has no obligation to provide support or maintenance for the Service.
  • In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service.
  • Apple is not responsible for addressing any claims you have related to the Service.
  • Apple is not responsible for any third-party claim that the Service or your use of it infringes intellectual property rights.

19. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy and any in-app disclosures, are the entire agreement between you and Linaw regarding the Service.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
  • No waiver. Failure to enforce any provision is not a waiver of future enforcement.
  • Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • Notices. We may contact you via the email associated with your Apple ID or via in-app notification. You may contact us at [email protected].
